This website is owned and operated by Senior Village Hub. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the opportunity to (i) (as a Host) promote a living space that they are legally allowed to promote for an agreed price, (ii) (as a Host) promote social events and otherwise interact with members on the platform to facilitate familiarity with members in order to assist the purpose of selecting suitable co-habitants. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
A Legal Disclaimer
The Senior Village Hub Platform enables users (“Members”) to publish, offer and search for accommodation services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests.” Hosts offer accommodations (“Accommodations”), activities, excursions, and events such as tours, classes, wellness sessions or outdoor activities which are designated as events on the Senior Village Hub Platform (“Events”). As the provider of the Senior Village Hub Platform, Senior Village Hub (or its affiliates) does not own, control, offer or manage any Listings or Host Services. Senior Village Hub is not a party to the contracts entered into directly between Hosts and Guests, nor is Senior Village Hub a real estate broker, travel agency, or insurer. Senior Village Hub is not acting as an agent in any capacity for any Member.
Your Responsibilities and Assumption of Risk
You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Co-tenant are legally entitled to use in connection with the Accommodation (“Common Areas”).
You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Senior Village Hub Platform and any Content including your residence (as a co-tenant) at any Accommodation, participation in any Service, Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.
Host Terms
You (the Host) are responsible for the accuracy of the information supplied or omitted from your Listing and content (like photos).
Your relationship with Senior Village Hub is that of an independent individual or entity and not an employee, agent, joint venturer, or partner. Senior Village Hub does not direct or control your Host Service, and you understand that you have complete discretion whether and when to provide Host Services, and at what price and on what terms to offer them.
You are responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing.
Limitations on Liability
Neither Senior Village Hub (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the Senior Village Hub Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Senior Village Hub Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Senior Village Hub Platform, or (iv) publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Senior Village Hub has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.
Indemnification
To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold Senior Village Hub harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature), (ii) your improper use of the Senior Village Hub Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in a Service, Experience, or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights. You agree to indemnify and hold Senior Village Hub harmless from and against any of the aforementioned claims, liabilities, damages, losses, and expenses, regardless of Senior Village Hub's responsibility for negligence and howsoever the same may be caused.
Third-Party Services
The Senior Village Hub Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Senior Village Hub is not responsible or liable for any aspect of such Third-Party Services.
Retention of Right To Change Offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Ownership of Intellectual Property, Copyrights and Logos
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Senior Village Hub. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.
Right to Suspend or Cancel User Account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Senior Village Hub be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, Senior Village Hub assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.
Right to change and modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.
Promotional emails and content
Many countries require that you receive the consent of your users before sending them promotional messages. The form of such consent and the legal requirements vary from country to country and therefore we recommend that you seek legal assistance on this subject.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the country and state where the property is situated, or where the event occurred, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the country and state where the property is situated, or where the event occurred. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
Provisions recommended for websites with user communities
Senior Village Hub offers its users the ability to create communities, in order to interact with co-members in a better way. All Senior Village Hub users accept that by joining this community, they will have a public profile that is publicly visible to site visitors, and that their public activity (such as their posts or comments) will be visible to other visitors of the Senior Village Hub website.
Users can always opt-out and exit the community, and upon doing so, such user’s profile will not be publicly visible. Naturally, in such event the user will not be able to use the community features (e.g. liking, commenting or writing posts).
